Copyright Protection of Web Site Content

Images, text, data, software, documentation, electronic text and image files, audio and video files and clips, and other information (collectively, the “Materials”) are protected by copyright laws and may be covered by other restrictions as well. The Charles Hosmer Morse Museum of American Art (the “Museum”) retains all rights, including copyright, in the Materials. Copyright and other proprietary rights may be held in individuals or entities other than, and in addition to, the Museum. Visitors to the morsemuseum.org web site are expressly prohibited from copying any of the protected materials on this web site, except for the purposes of fair use as defined in the copyright laws, and as described below.

Permitted Uses

Fair use of copyrighted material includes the use of protected materials for non-commercial, educational purposes, such as teaching, scholarship, research, criticism, commentary, and news reporting. unless otherwise noted, users who wish to download or print text, audio, video, image, and other files from the Museum’s Web site for such uses are welcome to do so without the Museum’s express permission. this includes using unaltered images or text in a school report; provided, however, it is a personal or academic work, and not for publication in any medium.

Users may also download the Materials for their own non-commercial personal use. Such personal use is subject to any additional terms or restrictions which may be applicable to the individual file or program.

Fair use or personal users must cite the author and source of the Materials as they would material from any printed work, and the citations should include the URL “http://morsemuseum.kinsta.cloud.”

The Museum does not warrant that use of the Materials displayed on the site will not infringe the rights of third parties not owned by or affiliated with the Museum. For example, works under copyright by the artist or the artist’s heirs holding rights to these works may not be used in any form; they may not be copied or downloaded without prior permission from the holder of the underlying copyright.

By downloading, printing, or otherwise using the Materials from the Museum web site, whether accessed directly from the Museum web site or via other sites or mechanisms, users agree that they will limit their use of the Materials to the uses authorized herein, and will not violate the Museum’s or any other party’s proprietary rights.

Prohibited Uses

Unauthorized publication or exploitation of the Materials is strictly prohibited. Anyone wishing to use the Materials for commercial use, publication, personal gain or any purpose other than as authorized herein, including placement of the Materials for any purpose on a Cd-ROM or public domain, must obtain prior written approval. Permission for such use is granted on a case-by-case basis at the sole discretion of the Museum. A usage fee may be charged depending on the nature of the proposed use. For use of works of art from the Museum’s collection reproduced on this site, in their entirety or as details, contact the Museum at (407) 645-5311. For use of works of art from other museums or institutions reproduced on this site, contact the institution credited in the work’s caption directly.

Prohibited Use of Trademarks

Many of the trademarks, service marks, and logos (collectively, the “Trademarks”) displayed on the Museum’s Web site are registered and/or unregistered marks of the Museum. The Trademarks of third parties may also be displayed on the Museum’s Web site. Nothing contained in the Museum’s Web site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademarks displayed on the Web site without the express written permission of the Museum or any third party that may own the Trademarks displayed on the Web site. Any unauthorized use of the Trademarks or any other Materials, except as authorized in these Terms and Conditions, is strictly prohibited.

Without limiting the foregoing, all Materials on the Web site are provided “AS IS” WITHOUT A WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, AND/OR NON-INFRINGEMENT. The Museum assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your use of the Web site or your downloading of any Materials from the Web site.
